Algemene Voorwaarden Huur Powerbanks (B2C)

1. Definities

App: Tappie

Consument: een Klant die niet handelt in de uitoefening van een beroep of bedrijf.

Dienst: Tappie B.V. exploiteert Powerstations met daarin Powerbanks. De Powerbanks kunnen door de Klant worden gehuurd tegen betaling.

Tappie B.V.: de gebruiker van deze algemene voorwaarden, de besloten vennootschap met beperkte aansprakelijkheid Tappie B.V., gevestigd aan Nijverheidstraat 11b, 7511 JM, Enschede, ingeschreven bij de Kamer van Koophandel onder nummer 98854097, met btw-nummer NL868672063B01.

Huurperiode: de periode beginnend op het moment dat de Powerbank door de Klant wordt uitgehaald bij een Powerstation van Tappie B.V. en eindigt wanneer de Powerbank zonder beschadigingen correct wordt ingeleverd.

Klant: de contractspartij van Tappie B.V. die een Powerbank huurt via een Powerstation of App.

Powerbank: de draagbare oplader die door Tappie B.V. aan de Klant ter beschikking wordt gesteld voor tijdelijk gebruik.

Powerstation: het verhuurstation van Tappie B.V. waar de Klant de Powerbank kan ophalen en retourneren.

2. Toepasselijkheid

  1. Deze voorwaarden zijn van toepassing op alle aanbiedingen, offertes, rechtshandelingen, huurtransacties of overige diensten van of met Tappie B.V.
  2. De (ver)nietig(baar)heid van één of meerdere bepalingen tast de rechtsgeldigheid van de overige bepalingen niet aan. Wettelijke conversie vindt plaats ex artikel 3:42 BW.
  3. Afwijkingen zijn uitsluitend geldig indien schriftelijk overeengekomen tussen de Klant en Tappie B.V.

3. Account en App

  1. Om gebruik te maken van de diensten van Tappie B.V. dient de Klant een account aan te maken en juiste informatie te verstrekken.
  2. Door gebruik te maken van de dienst verklaart de Klant 16 jaar of ouder te zijn. Indien jonger, is toestemming van ouders/verzorgers vereist.
  3. De Klant is verantwoordelijk voor het veilig bewaren van het wachtwoord. Bij vermoeden van misbruik dient contact te worden opgenomen via info@ikwiltappie.be.
  4. De Klant is zelf verantwoordelijk voor geschikte hardware. Tappie B.V. garandeert niet dat de App altijd op ieder toestel functioneert.

4. Huur en gebruik

  1. De huur vangt aan op het moment dat de Klant de Powerbank uit het Powerstation haalt.
  2. De Klant gebruikt de Powerbank zorgvuldig en uitsluitend volgens de instructies van Tappie B.V., zoals weergegeven in de App, op het Powerstation en via ikwiltappie.nl.
  3. De Klant inspecteert de Powerbank vóór gebruik en meldt schade direct via info@ikwiltappie.be.
  4. Tijdens de Huurperiode is de Klant aansprakelijk voor verlies, diefstal of beschadiging tot maximaal €30,-, behoudens opzet of grove schuld van Tappie B.V.
  5. Het is de Klant niet toegestaan de Powerbank te openen, demonteren, modificeren of aan derden ter beschikking te stellen.
  6. De Powerbank blijft te allen tijde eigendom van Tappie B.V.
  7. De Klant heeft een controletijd van 2 minuten na ontvangst om zichtbare schade te melden via info@ikwiltappie.be.

5. Retourneren van de Powerbank

  1. De Klant is verantwoordelijk voor correcte en tijdige retournering.
  2. Indien de Powerbank niet binnen 24 uur correct wordt geretourneerd, wordt deze als aangekocht beschouwd en is de Klant €30 inclusief btw verschuldigd.
  3. Bij overschrijding van de huurperiode is een vergoeding verschuldigd van €1 per aangevangen half uur.
  4. De registratie van het systeem van Tappie B.V. is leidend bij vaststelling van huurperiode en retour.

6. Vergoeding en betaling

  1. Betaling geschiedt tegen de op het Powerstation, in de App of via ikwiltappie.nl weergegeven tarieven, inclusief btw.
  2. Betaling vindt plaats via automatische incasso.
  3. Bij stornering blijft de Klant betalingsplichtig.
  4. Incassokosten bedragen 15% van het openstaande bedrag.
  5. Bezwaar kan binnen 14 dagen worden ingediend via info@ikwiltappie.be.
  6. Tappie B.V. kan kortingscodes verstrekken voor privégebruik.

7. Gegevens en gegevensbescherming

  1. Tappie B.V. verwerkt persoonsgegevens conform de AVG.
  2. Passende technische en organisatorische beveiligingsmaatregelen worden getroffen.
  3. De privacyverklaring is beschikbaar via ikwiltappie.nl.

8. Aansprakelijkheid en garanties

  1. Tappie B.V. garandeert geen compatibiliteit met apparaten van de Klant.
  2. Tappie B.V. is niet aansprakelijk voor indirecte schade of gevolgschade.

9. Toepasselijk recht en geschillen

  1. Op deze overeenkomst is uitsluitend Nederlands recht van toepassing.
  2. Geschillen worden voorgelegd aan de bevoegde rechter van de Rechtbank Midden-Nederland.

10. Slotbepalingen

  1. Klachten kunnen worden ingediend via info@ikwiltappie.be.
  2. De meest actuele versie van deze voorwaarden is beschikbaar via de App en op ikwiltappie.nl.
  3. Door gebruik te blijven maken van de diensten van Tappie B.V. verklaart de Klant akkoord te gaan met de gewijzigde voorwaarden.

 

Terms and Conditions for Renting Powerbanks (B2C)

1. Definitions

App: Tappie

Consumer: a Customer who does not act in the course of a profession or business.

Service: Tappie B.V. operates Powerstations containing Powerbanks. Customers can rent the Powerbanks for a fee.

Tappie B.V.: the user of these terms and conditions, the private limited company Tappie B.V., located at Nijverheidstraat 11b, 7511 JM, Enschede, registered with the Chamber of Commerce under number 98854097, with VAT number NL868672063B01.

Rental Period: the period starting when the Customer takes the Powerbank from a Tappie B.V. Powerstation and ending when the Powerbank is returned without damage in the prescribed manner.

Customer: the contracting party of Tappie B.V. who rents a Powerbank via a Powerstation or App.

Powerbank: the portable charger made available by Tappie B.V. to the Customer for temporary use.

Powerstation: the rental station of Tappie B.V. where the Customer can pick up and return the Powerbank.

2. Applicability

  1. These terms and conditions apply to all offers, quotations, legal acts, rental transactions, or other services provided by or in conjunction with Tappie B.V.
  2. The invalidity of one or more provisions does not affect the validity of the remaining provisions. Legal conversion applies pursuant to Article 3:42 of the Dutch Civil Code.
  3. Deviations from these terms are only valid if agreed upon in writing between the Customer and Tappie B.V.

3. Account and App

  1. To use the services of Tappie B.V., the Customer must create an account and provide accurate information.
  2. By using the service, the Customer declares to be 16 years of age or older. If younger, parental or guardian consent is required.
  3. The Customer is responsible for keeping their password secure. If misuse is suspected, contact must be made via info@ikwiltappie.be.
  4. The Customer is responsible for having compatible hardware. Tappie B.V. does not guarantee that the App will function on all devices.

4. Rental and Use

  1. The rental period starts when the Customer takes the Powerbank from the Powerstation.
  2. The Customer must use the Powerbank carefully and strictly according to the instructions of Tappie B.V., as displayed in the App, on the Powerstation, and on ikwiltappie.nl.
  3. The Customer must inspect the Powerbank before use and report any damage immediately via info@ikwiltappie.be.
  4. During the Rental Period, the Customer is liable for loss, theft, or damage up to a maximum of €30, except in cases of intent or gross negligence by Tappie B.V.
  5. The Customer is not allowed to open, disassemble, modify, or transfer the Powerbank to third parties.
  6. The Powerbank remains the property of Tappie B.V. at all times.
  7. The Customer has a 2-minute inspection period after receiving the Powerbank to report visible damage via info@ikwiltappie.be.

5. Returning the Powerbank

  1. The Customer is responsible for returning the Powerbank correctly and on time.
  2. If the Powerbank is not returned correctly within 24 hours, it will be considered purchased by the Customer, who must pay €30 including VAT.
  3. If the rental period is exceeded, an additional fee of €1 per commenced half-hour applies.
  4. The system records of Tappie B.V. are decisive for determining the rental period and return.

6. Fees and Payment

  1. Payment is based on the rates displayed on the Powerstation, in the App, or via ikwiltappie.nl, including VAT.
  2. Payment is made via direct debit.
  3. If the payment is rejected, the Customer remains liable.
  4. Collection costs are 15% of the outstanding amount.
  5. Objections can be submitted within 14 days via info@ikwiltappie.be.
  6. Tappie B.V. may provide discount codes for private use only.

7. Data and Data Protection

  1. Tappie B.V. processes personal data in accordance with the GDPR.
  2. Appropriate technical and organizational security measures are taken.
  3. The privacy policy is available via ikwiltappie.nl.

8. Liability and Guarantees

  1. Tappie B.V. does not guarantee compatibility with the Customer’s devices.
  2. Tappie B.V. is not liable for indirect or consequential damages.

9. Applicable Law and Disputes

  1. These terms are governed exclusively by Dutch law.
  2. Disputes are submitted to the competent court of the District Court Midden-Nederland.

10. Final Provisions

  1. Complaints can be submitted via info@ikwiltappie.be.
  2. The most current version of these terms is available in the App and on ikwiltappie.nl.
  3. By continuing to use Tappie B.V.’s services, the Customer agrees to the amended terms.
